ADOPTION OF DENR RECOGNIZED ENVIRONMENTAL LABORATORIES

          Whereas, DENR Administrative Order No. 98-63 provides the guidelines for the designation of DENR-Recognized Environmental Laboratories;

          Whereas, the LLDA is an attached agency of the DENR by virtue of Executive Order No.149;

          Whereas, the DENR has approved the recognition of several laboratories nationwide, some of which are within the LLDA area of jurisdiction;

           Whereas, industries within the LLDA area of jurisdiction are required to submit Self-Monitoring Reports (SMR) on a regular basis;

           Whereas, the services of  DENR-recognized laboratories are needed to generate the necessary data for the SMR;

           Now, therefore, for and in consideration of the above premises, be it resolved, as it is hereby resolved, that the LLDA recognize the laboratories issued recognition by the DENR through DENR Administrative Order No. 98-63 based on the following guidelines:

       1.     The results of analysis of the DENR-Recognized Laboratories may be used by industries for their SMR and other legal purposes. In the event of conflicting results, the LLDA Laboratory results for samples taken by the Pollution Control Division (PCD) shall prevail.

2.     Only the results from recognized laboratories shall be accepted for the SMR. However, for firms which have their own (in-house) laboratories their own results of laboratory analysis can be accepted for the SMR provided that they notify the LLDA of the existence of such laboratory. Eventually, such firm-based laboratories shall seek their own recognition by the DENR subject to separate guidelines to be issued by the LLDA.

      3.     The industry must submit to LLDA a certified true copy of the valid DENR Certificate of Recognition of the laboratory.

4.     Suspension, revocation or non-renewal of the laboratory’s Certificate of Recognition will drop them from the list of laboratories recognized by LLDA.

     5.     The recognized laboratories must comply with the requirements of the DAO 98-63.
