ADOPTION OF ENVIRONMENTAL IMPACT ASSESSMENT (EIA) SYSTEM AND ITS IMPLEMENTING RULES AND REGULATIONS. WHEREAS,
Republic Act No. 4850, as amended by Presidential Decree No. 813, s.
1975, and Executive Order No. 927, s. 1983, vested the Laguna Lake
Development Authority with the mandate to monitor and regulate
activities in the Laguna de Bay Region, to pass upon all plans,
programs, and projects proposed within the Region and issue permits
and clearances to implement these mandates;
WHEREAS, Presidential Decree
No. 1586, s. 1978, established the Environmental Impact Statement
System and provides that no person, partnership or corporation shall
undertake or operate any project declared as environmentally
critical or is located within an environmentally critical area
without first securing an Environmental Compliance Certificate (ECC)
issued by the President or his duly authorized representative;
WHEREAS,
Administrative Order No. 42, dated
2 November 2002, streamlined the EIS processing system and delegated
the ECC approving authority to the Secretary of the Department of
Environment and Natural Resources (DENR) and the Director and
Regional directors of the Environmental Management Bureau (EMB) of
the DENR;
WHEREAS,
by
virtue of Executive Order No. 149 dated 28 December 1993, the LLDA
was transferred from the Office of the President to the DENR for
policy and program coordination and administrative supervision; WHEREAS,
there
is a need to rationalize and liberalize the issuance of the ECC in
the Laguna de Bay Region to ensure efficiency and responsiveness to
the needs of the stakeholders and investors, without compromising
environmental protection and conservation of natural resources; WHEREAS,
the
Secretary of the DENR issued Administrative Order No. 61, Series of
2004, delegating to the LLDA General Manager the Authority to grant
or deny the issuance of Environmental Compliance Certificate /
Certificate of Non-Coverage (ECC/CNC) for projects located within
the Laguna de Bay Region; NOW,
THEREFORE,
foregoing premises considered, BE
IT RESOLVED, as it is hereby RESOLVED,
that the LLDA adopt
the Environmental Impact Assessment (EIA) System and its
Implementing Rules and Regulations in the Laguna de Bay Region
starting 01 December 2004. RESOLVED,
Further,
that the Environmental Impact Assessment Unit (EIAU) created by the
Office of General Manager under Memorandum Circular No. 81, Series
of 2004, shall endeavor to harmonize the ECC and LC issuances. In
the same manner, review the EIAS-IRR and make appropriate
recommendations to make it more suitable to LLDA requirements but
without compromising the objectives of PD 1586. RESOLVED,
Further,
that pending the completion of the review and harmonization of ECC
and LC, only the procedural requirements will be simplified but not
the prescribed existing fees/penalties. RESOLVED,
Further,
that the General Manager be authorized, as he is hereby authorized,
to enter and sign agreements in furtherance of PD 1586
implementation. APPROVED
