Board Resolution No.295, Series of 2006

 

ADOPTING THE GUIDELINES ON THE USE OF SHORELINE OF SAMPALOK LAKE, SAN PABLO CITY AND ITS DEVELOPMENT INTO RECREATIONAL PARK

Whereas, Executive Order 927 provides that the land and waters of the Laguna de Bay Region including the Seven Lakes of San Pablo are limited resources requiring judicious management for their optimal utilization to ensure renewability and to preserve its ecological balance;

Whereas, the co- management approach in managing the Seven Lakes pursuant to LLDA Board Resolution No. 26, Series of 1996 has developed awareness and participation among the stakeholders to plan for the protection of the lakes and to pilot development activities in Sampaloc Lake which is being strategically located within the heart of the City of San Pablo and the biggest among the seven lakes;

Whereas, one of the agreements reached during the multi-sectoral consultation on the use of Sampalok lake in February and June 2000 was the rehabilitation and conservation of the lake and its surrounding area for eco-tourism purposes, with emphasis on maintenance and protection of the easement thereof which shall be free from any establishment;

Whereas, accordingly, item 1.1.1.8(b), Section 7 of the 2000 Comprehensive Zoning Ordinance of the City of San Pablo designated the shoreline of Sampalok  Lake particularly known as Dagatan Blvd., for park development which policy also conforms to the criteria as provided for in Sec. 6.1 and 6.2 of DENR Administrative Order No. 99-39 entitled “Guidelines for the Development and Management of Ecological Destinations in the Philippines;

Whereas, the Authority recognizes that the lake’s easement maybe utilized for more beneficial uses through recreational purposes without sacrificing the lake’s ecological integrity and fishery use, while contributing to the economic growth of the community;

WHEREFORE, FOREGOING PREMISES CONSIDERED, be it resolved, as it is hereby resolved, that the guidelines on the use of shoreline of Sampalok lake and its development into recreational park is hereby adopted to properly protect and conserve the lake resources;

RESOLVED FURTHER, the experiences and lessons learned from the adoption and implementation of these guidelines shall be properly documented and assessed for possible replication of a similar policy for the other crater lakes.

 ARTICLE I

 Section 1. These rules and regulations shall be known as “Guidelines for the Use of Shoreline of Sampalok Lake, San Pablo City and its development into a recreational park”.

 Section 2. Objective

 The development of  the Sampalok Lake easement into parks is aimed to promote public awareness on environmental protection, to prevent rebuilding of illegal structures within the lake’s periphery and to support the rehabilitation of the Sampalok lake environment from further degradation while contributing to the economic growth of the City with due priority to the less privileged sector in the area

 Section 3. Scope

 These rules and regulations shall apply to all development activities and use of parks specifically located within the lake’s easement in Dagatan Blvd., along Sampalok.

 Section 4. Definition of Terms

 When used in these rules and regulations, the following terms and phrases shall have the indicated meaning as follows:

 

  1. Authority- refers to the Laguna Lake Development Authority
  1. Access lanes- designated areas with a minimum width of 20 meters perpendicular to the lakeshore intended solely for ingress and egress passage
  1. LGU- refers to the City of San Pablo
  1. Parks- an area within the lake’s easement that offers educational, environmental, recreational  and aesthetic values.
  1. Proponent- any person or group of persons with interest to engage in developing Sampalok Lake’s natural landscape
  1. Permanent structures- refers to any structure of all sorts that would obstruct or defeat the recreational and environmental purpose of the parks.
  1. Sampalok Lake easement- strip of land which is part of Sampalok Lake from the edge of lake waters towards the road.

 ARTICLE II 

Section 5. The Park Zone (PZ)

  1. The parks shall be located within the lake’s entire easement which shall be subdivided into blocks with a minimum horizontal length of twenty (20.0) meters per block
  1. The Authority shall take charge of subdividing the area within each block and shall provide complete information thereon as regards the technical dimension of the said block, including the designated access lanes and clearing sites per barangay

 Section 6.  Area Allocation of Parks 

  1. Qualified proponents will be assigned their permanent block number
  1. In case the present block is already occupied with mini parks, the same area shall be awarded to the existing occupant in accordance with the order of priority provided he/she complies with all other conditions set herein.

Section 7. Other Land Embankment Activities

  1. A minimum of 3.0- meter setback from the circumferential road opposite the PZ shall be observed.
  1. Private land owners located opposite the PZ may be encouraged to develop legitimate tourism oriented business such as handicraft stores, eateries, souvenir shops and mini hotels provided the such 3.0 meters setback is observed.  Legitimate food stall vendors’ association shall likewise be allowed in San Pablo City’s designated zone for stall vendors.
  1. Appropriate sanitation facilities shall be appropriately established in strategic location

Section 8. Requisites for the Establishment and Operation of Parks

  1. Any interested proponent including those with Deed of Undertaking existing with the Authority shall secure clearance/permit from the Authority in coordination with the LGU. The application in a prescribed form shall be submitted to the LGU supported by official receipt evidencing payment of the filing fee and other important data as may be required.
  2. A project design indicating all of the following shall likewise be attached to and shall become part of the application:
    1. A natural landscape with riprap, when necessary, to ensure the stability of the lakeshore
    2. Planting of grass and flowering plants
    3. Installation of benches
    4. Installation of lights posts along the circumferential road
    5. Provisions of garbage cans
    6. Maintenance program of the area

Section 9. General Prohibition

  1. Blocking of the designated access lanes
  2. Obstruction and encroachment on the existing barangay road
  3. Backfilling
  4. Exclusive use and benefit of the proponent, private individual or entity on the established parks
  5. Littering
  6. Posting of commercial signboards
  7. Use of PZ for habitation and any business purposes

Section 10. Penalties

 An administrative fine of P5,000.00 shall be imposed on any proponent for failure and/or non compliance with any of the provisions of these guidelines. Individuals found violating the Anti-Littering Law shall be subject to the LGU rules and regulations.

Section 11.  Effectivity

 This resolution shall take effect fifteen (15) days upon publication in a newspaper of general circulation and shall remain in force and effect unless otherwise revoked or amended by the Authority’s Board of Directors after due public consultation.
