A BOARD RESOLUTION AMENDING BOARD RESOLUTION NO. 226 SERIES OF 2004, BY FURTHER AMENDING THE MODIFIED SHARING OF FISHPEN FEES FOR LGU’S THEREIN PROVIDED AND FOR OTHER PURPOSES.
Wherein,
Section 3 of Rep. Act Nop.4850 (1966), as amended by Pres. Decree
No. 813 (1978) and further amended by Exec. Order No. 927 (1983),
provides Collection of Fees.- The
Authority is hereby empowered to collect fees for the use of the
lake waters xxx including but not limited to fisheries xxx.
Provided, that the rates of the fees collected, and the sharing with
other government agencies and political subdivisions, if necessary
shall be subject to the approval of the President of the Philippines
upon recommendation of the Authority’s Board
except fishpen fee which will be shared in the manner:20
percent of the fee shall go to the lakeshore local governments, 5
percent shall go to the Project Development Fund xxx and the
remaining 75 percent shall constitute the share of LLDA. However,
after the
implementation within the three-year period of the Laguna lake
Fishery Zoning and Management Plan, the sharing will be modified as
follows: 35% of the fishpens fee goes to the lakeshore local
governments 5% goes to the Project Development Plan and the
remaining 60% shall be retained by LLDA: xxx” Whereas,
from year 1983 to year 1996, the fishpen fees collected by this
Authority from fishpen operators were distributed and shared as
follows: LLDA(75%)

further that the distribution of this 15% additional lakeshore LGU
respective shares of the lakeshore barangays and the lakeshore
municipalities be entrusted to the chief executive of the Province
for distribution and shall be accountable to and shall see to it
that the same is disburse or expended for purposes relevant to the
enhancement and protection of the environment and/or appurtenant
purposes or in pursuit thereof; Resolved,
lastly; that the General Manager is authorized to promulgate and
issue such further guidelines, rules and regulations he may deem
expedient, fit and proper to carry out the purposes upon which this
distribution, allocation or sharing is made. Approved
