AMENDING BOARD RESOLUTION NO. 42,
SERIES OF 1997, ON ADMINISTRATIVE FINES FOR
VIOLATIONS OF LLDA RULES AND REGULATIONS |

WHEREAS,
the schedule of fines for a specific
violation of LLDA’s Rules and Regulations was approved on March 21, 1997,
under Board Resolution No. 42, Series of 1997;
WHEREAS, a
review of LLDA’s rules and procedures was called for to address the concerns
of the industry sector;
WHEREAS, one
of the areas for consideration is the imposition of administrative fines for
operating without LLDA clearance pursuant to the aforestated Resolution;
WHEREAS, a
review of the procedures on the processing of LLDA clearance finds the need to
amend certain provisions relative to the imposition of administrative fines;
NOW,
THEREFORE,
foregoing premises considered, BE IT
RESOLVED, as it is hereby RESOLVED,
to amend Board Resolution No. 42, Series of 1997, as underlined below:

RESOLVED, FURTHER, that in the
case of violation of the requirement to secure a valid LLDA Clearance (LC) prior
to undertaking any development activity within the Laguna de Bay Region, an
administrative fine of FIVE THOUSAND PESOS (PHP5,000) per year of operation
shall be imposed reckoned from the date of receipt of the Notice of Violation
(NOV). However, for those who
voluntarily apply for a LC sans NOV, the administrative fine shall be reduced by
fifty percent (50%) provided that any
development activity for which a LC is secured must conform with all existing
rules and regulations of the Authority. RESOLVED, FURTHERMORE,
