AMENDING SECTION 4.3 OF THE RULES AND REGULATIONS IMPLEMENTING THE REVISED LAGUNA DE BAY FISHERY ZONING AND MANAGEMENT PLAN (ZOMAP) OF 1996 |

WHEREAS,
as called for in the Master Plan for the Laguna de Bay Region, the
Revised ZOMAP of 1996 and its Implementing Rules were approved under Resolution
No. 5, Series of 1996; WHEREAS,
Section 4.4 of the Implementing Rules provides that fishpen areas will be
allocated to other operators not included in the prioritization scheme for
registration, after all qualified operators shall have been registered and there
are areas still available within the 10,000-hectare limit;
WHEREAS,
existing records showed that these fishpen operators listed under Sec. 4.4
(i) of
the above-stated Rules are those who registered with the LLDA for the past
several years up to 1994 but failed to renew their licenses for 1995 by reason
of the Court of Appeals’ decision enjoining the LLDA from issuing fishpen
permits and authorizing the lakeshore mayors to issue the same; WHEREAS,
initial screening of qualified operators and survey of fishpen areas
showed that areas may still be available to operators not included in the first
batch of registrants; NOW, THEREFORE,
foregoing premises considered, BE
IT RESOLVED, as it is hereby RESOLVED,
to amend Section 4.3 of the Rules and Regulations Implementing the Revised
Laguna de Bay Fishery Zoning and Management Plan of 1996, to read as follows :
Section
4.3
- In case the present area occupied by the registered fishpen happens to be outside the
new fishpen belt, the following order of priority will be observed in the
process of area allocation: (i) x x x (vi) Those who registered with the LLDA in 1994 and have submitted a formal communication to register in 1995; provided that arrears for 1995 are paid. x x x
