INSTITUTIONALIZING THE RIVER REHABILITATION AND PROTECTION COUNCILS/FOUNDATIONS FOR THE TWENTY-ONE RIVER BASINS IN THE LAGUNA DE BAY REGION

 

     WHEREAS, the Laguna de Bay and its 21 major tributary river systems form part of one of the most important natural asset base of the country;

 

     WHEREAS, creation of enabling conditions/structures to assist various stakeholders to manage and build their capacities towards sustainable development of water resources, among others, is part of the Action Agenda under the Philippine Agenda 21;

 

     WHEREAS, consistent with the Philippine Agenda 21 Action Program and as part of its overall resource management strategy, the Laguna Lake Development Authority (LLDA) embarked on and has sustained the implementation of a program to rehabilitate and protect the 21 major river systems flowing into Laguna de Bay;

 

     WHEREAS, to sustain the river rehabilitation efforts, it is essential that broad multi-sectoral support and involvement from various stakeholders in each of the 21 river basins is generated;

 

     WHEREAS, the LLDA has organized River Rehabilitation and Protection Councils/Foundations in the watershed of each tributary river system of the lake as an effective mechanism to ensure voluntary and multi-sectoral partnership and stakeholders’ involvement in the sustainable management of the various river systems;

 

     NOW, THEREFORE, foregoing premises considered, BE IT RESOLVED, as it is hereby RESOLVED, to institutionalize and officially recognize the River Rehabilitation and Protection Councils/Foundations organized by the LLDA with the responsibility of working, hand in hand with the Authority, for the rehabilitation, protection and sustainable development of specific river basins in the Laguna de Bay Region;

 

     RESOLVED, FURTHER, to approve the Implementing Guidelines on the Institutionalization of River Rehabilitation and Protection Councils/Foundations for the Twenty-One River Basins in the Laguna de Bay Region attached as Annex A;

     RESOLVED, FINALLY, to authorize the General Manager to enter into separate agreement with each river council/foundation for the adoption and operationalization of river rehabilitation plans and extension of support/assistance to the council.

IMPLEMENTING GUIDELINES ON THE INSTITUTIONALIZATION OF THE RIVER REHABILITATION AND PROTECTION COUNCILS/FOUNDATIONS FOR THE TWENTY-ONE RIVER BASINS IN THE LAGUNA DE BAY REGION

 

 

ARTICLE I.  Title.  These guidelines shall be known and cited as the “Implementing Guidelines for the Institutionalization of the River Rehabilitation and Protection Councils/Foundations for the Twenty One River Basins of the Laguna de Bay Region.”

 

ARTICLE 2.  Statement of Policy.    The Authority recognizes that integrated lake basin or watershed approach ensures the sustainability of the lake’s environment.  Such integrated approach as applied to water resources management recognizes that river basin is the most appropriate management unit focusing on hydrologically defined drainage basin or watershed.  At the core of this river basin approach are the stakeholders and the process of multi-stakeholder partnership and involvement.  In this context, the LLDA shall therefore pursue the creation and localization at the river basin level of enabling structures and mechanisms to mainstream the various stakeholders and build their capacities towards integrated water resources management.

 

ARTICLE 3.  Scope and Coverage.  These guidelines shall cover those River Rehabilitation and Protection Councils/Foundations duly organized and recognized by the LLDA in the 21 river basins of the Laguna de Bay Region.

 

ARTICLE 4. Definition of Terms.  For the purpose of these guidelines, whenever any of the following words, terms, phrases or abbreviations are used herein or in any amendment or supplementary thereto which may be issued hereafter, they shall have the meaning ascribed in these guidelines:

 

a.

Authority or LLDA means the Laguna Lake Development Authority;

 

b.

 

River Council/Foundation is a non-stock, non-profit, private entity organized by the LLDA, to promote multisectoral partnership between the government and private sector towards the protection, rehabilitation and sustainable development of the natural environment in the Laguna de Bay Basin specifically the tributary river systems which drain into the lake;

 

c.

 

Laguna de Bay Watershed/Region/Basin as defined in Republic Act 4850, as amended by P.D. 813 and E. O. 927, consists of all provinces, municipalities and cities traversed by the river systems draining into Laguna de Bay.    The Laguna de

Bay Region encompasses  the whole provinces of  Laguna and Rizal; the chartered cities of  Pasay, Caloocan, Quezon, Manila, Muntinlupa, Marikina, Pasig, Antipolo, Tagaytay, and San Pablo; Silang and Carmona in Cavite; Tanauan, Sto. Tomas and Malvar in Batangas and Lucban, Quezon as well as Taguig and Pateros in Metro Manila;

 

d.

 

Watershed is a topographic and hydrological unit encompassing areas of land from which rainwater can drain to a common outlet such as the lake and rivers in this instance;

 

e.

 

River System refers to any of the 21 major tributary river systems and comprises the river and its tributaries forming a branching of water channels;

 

f.

 

River Basin or Drainage Basin is the area drained by a river consisting of the main river and the tributaries; and

 

g.

 

Tributary is a waterway that flows to the main river.

 

     ARTICLE 5.  Organization of the River Councils/Foundations.  The River Councils/Foundations shall be formed by the LLDA from the ranks of various sectors which include representatives from the local government, national government agencies mandated to protect the environment, non-governmental organizations, people’s organizations, homeowners’ association, industrial and commercial establishments, civic as well as religious organizations.  In organizing the envisioned council, representatives from various sectors shall first be gathered by the LLDA in a forum where the proposal for organizing the river councils shall be discussed.  From the sectoral representatives, potential cooperators shall be identified to act as the core group of committed environmentalists to initiate and sustain the efforts towards river rehabilitation, protection and sustainable development.

 

    ARTICLE 6. Functions and Duties of the River Councils/Foundations.  The River Councils/Foundations shall perform the following functions and duties:

 

1.

Vigorously pursue a comprehensive and sustained River Rehabilitation Program for the specific river basin;

 

2.

 

Mobilize various sectors in the community, towns and cities within the catchment of specific river systems in order to be intimately involved in the effort to protect our rivers and lake;

 

3.

 

Undertake information, education and motivation campaigns to raise the level of environmental and health awareness of the people in the communities;

4.

Regularly conduct physical survey of the river including flow measurement to assess its current condition,  identify environmental problems and issues, pinpoint sources of pollution and other factors affecting its environmental quality and, on the basis thereof, to formulate, prioritize and undertake appropriate measures to effectively address the identified problems and issues;

 

5.

 

Formulate technically and environmentally-sound Watershed Management Plans and/or project proposals and submit such plans and proposals to potential funding agencies or institutions;

 

6.

 

Establish and maintain close linkage with the LLDA for the necessary expertise, capability and know-how to undertake periodic water quality assessment especially of identified establishments or entities discharging wastewater directly into the rivers;

 

7.

 

Act as network of environmental stewards and report to LLDA and other duly constituted authorities all cases of violations of environmental laws,  regulations and standards;

 

8.

 

Raise funds for the Watershed Management Plan, River Rehabilitation Program and/or river protection, rehabilitation and/or development projects;

 

9.

 

Undertake other functions and tasks in accordance with the main objectives set by the River Councils.

 

     ARTICLE 7.  Board of Trustees: Composition.  For each of the river basin of the Laguna de Bay Region, the policy making powers and functions shall be vested in and exercised by a Board of Trustees, hereinafter referred to as the Board, which shall be composed of the LLDA, municipalities/cities within the river basin, non-governmental organizations, people’s organizations, industries, civic and religious organizations and other private individuals or entities desiring to be involved in the protection and management of the river system.

 

     ARTICLE 8.  Executive Committee.  To implement all policies and guidelines issued by the Board of Trustees and oversee the day-to-day operation of the council, an Executive Committee shall be created to be composed of a President who will act as presiding officer in all meetings of the Council or Foundation; a Vice-President who shall assist the President in all executive functions and shall be designated as the Officer-in-Charge during the absence of the President,  a Secretary who shall be responsible mainly for recording the minutes of each meeting, documenting  the  activities  of  the  organization  as  well as internal and

external communications,  a Treasurer who shall manage the funds of the organization in accordance with sound accounting and auditing principles.  All officers of the Executive Committee are automatically members of the Board of Trustees.

 

     ARTICLE 9.  Operational Committees.  In carrying out the activities of the council/foundation, the President shall be assisted by four (4) Operational Committees, as follows:

 

a.

A Ways and Means Committee shall be responsible for fund raising and logistical support for all the activities of the organization;

 

b.

 

An Operations Committee shall be responsible for implementing plans, programs and projects approved by the Council;

 

c.

 

An Education and Communications Committee shall be responsible for all information dissemination, Education  or Motivation Campaigns and shall be in charge of social mobilization whenever such is deemed necessary; and

 

d.

 

A Technical Committee shall be in charge of all planning functions including the conceptualization and development of project proposals and other studies requiring technical and other inputs.

 

     ARTICLE 10.  Meetings.  The meetings of the Board of Trustees shall be in accordance with the provisions of the Corporation Code for non-stock non-profit organizations.

 

     ARTICLE 11.  Secretariat.  The LLDA shall act as the Secretariat for each of the River Councils/Foundations until such time that they have acquired necessary organizational stability and strength to function effectively and self-manage their affairs.

 

     ARTICLE 12.  Technical and Financial Assistance.  The LLDA shall provide the members of the River Councils/Foundations with necessary training, education, and information in order to equip them with the necessary expertise, knowledge, foundation on the basic principles of integrated resource management.  Furthermore, the LLDA shall extend to the River Council financial support as may be agreed upon to enable such Councils to pursue a Comprehensive River Rehabilitation Program for specific river basin. The financial and other assistance shall be covered by an appropriate memorandum of agreement.

     ARTICLE 13.  Final Provisions

 

     Section 1. Monthly Reports.  The Community Development Division shall submit to the General Manager a monthly report on all undertakings dealing with River Rehabilitation and Protection Councils/Foundations including, but not limited to, projects and activities funded through the LLDA financial assistance.

 

     Section 2. Separability Clause. Any provision or portion of these Implementing Guidelines declared invalid or unconstitutional shall not affect its other provisions to which the declaration does not relate.

 

     Section 3.  Repealing Clause.  All LLDA orders, guidelines, circulars, rules and regulations inconsistent herewith are hereby repealed or amended accordingly.

 

     Section 4.  Prohibitions.  Subject to existing rules and regulations on the implementation of the Election Ban, no undertaking of any magnitude shall be pursued by the Council/Foundation during such period.  Under these circumstances, the LLDA shall automatically assume the Council/Foundation’s functions and responsibilities.

 

     ARTICLE 14.  Effectivity.  These implementing guidelines shall take effect upon approval.
