The Management is aware of and recognizes the predicaments and difficulties confronting fishpen and fishcage operators of the Laguna de Bay caused by typhoon "Milenyo" which hit and caused massive destruction of fishpenlfishcage structures in the Laguna Lake last year resulting to losses worth millions of pesos to the fishpen industry.

I.    Coverage  

All delinquent fishpen/fishcage operators in the Laguna de Bay with area allocation in the designated fishpenlfishcage belts or with Notice of Award to operate an area in the lake.

II.    Terms and Conditions 

The payment of fishpenlfishcage fees for years 2006 and 2007 may be paid on installment basis for a period of two (2) years from the date of initial payment/down payment subject to the following conditions: 

a)   Payment on installment basis of fishpen/fishcage fees is applicable only for the years 2006 - 2007 registrations, which installment payment shall be made within a period of 2 years from the date of initial/down payment.

b)   It should not establish a precedent in future registrations since the event/circumstance was caused by an extraordinary phenomenon.

c)   Fishpen/fishcage operators who will avail of this privilege shall first settle and/or pay in full all its outstanding accounts, arrearages and surcharges which accrues for the past years prior to year 2006. A discount of five (5%) percent of the total obligations due and outstanding shall be granted in case of full payment of the principal account, arrearages and surcharges which accrued prior to year 2006.

d)   Fishpen/fishcage operators without outstanding accounts may opt to pay the current fees on installment basis but not later than December 2007. A discount of five (5%) percent of the total current fees shall be granted in case of full payment of accounts which accrue for the year 2006-2007.

e)   Only Manager's checks, Cashier's checks or Cash shall be accepted as payment.

III.    Qualification of Fishpen/fishcage Operators  

The qualification of fishpen/fishcage operators in addition to the existing fishpen and fishcage requirements shall be as follows:

1.    Submit a written request/appeal including a notarized undertaking to pay his obligation on installment. 

2.    Without violation or pending case with the Authority other than being delinquent.

Accordingly, the Finance Division shall make the restructuring of accounts once the request was approved. Initial payment shall be made upon registration for 2007. 

No fishpen permit will be issued unless the fishpen fee is paid in full.

This Memorandum Circular shall take effect immediately and shall remain enforceable unless revoked or superseded.
