MEMORANDUM CIRCULAR No. 5, Series of 2008

 SIMPLIFYING THE REQUIREMENTS FOR LLDA CLEARANCE APPLICATIONS

DENR Memorandum Circular No. 2007-08 dated 13 July 2007 “Simplifying the Requirements for Environmental Compliance Certificate and Certificate of Non-Coverage” states that: 

“No permits, and/or clearances issued by other National Government Agencies and Local Government Units shall be required in the processing of ECC or CNC applications and that the findings and recommendations of the Environmental Impact Assessment (EIA) shall be transmitted to relevant government agencies for them to integrated in their decision making prior the issuance of clearances, permits and licenses under their mandates.” 

Accordingly, in the interest of efficient environmental governance, and in order to harmonize the requirements for LLDA Clearance (LC) applications with aforementioned DENR Memorandum Circular, and to guide the operating and enforcing units of the Authority in the acceptance and processing of LC applications, the following guidelines are hereby adopted:

 

I.    Coverage  

These guidelines shall apply to all existing and/or new development projects, installations and activities in the Laguna de Bay Region that are required to secure a clearance from the LLDA, pursuant to Board Resolution No. 41, Series of 1997 and Board Resolution No. 223, Series of 2004.

 

II.    Requirements for LLDA Clearance Application 

As a general rule, all LC applications must be submitted with complete documentary requirements as follows: 

a)   Duly accomplished and notarized Application Form;

b)   Environmental Compliance Certificate or Certificate of Non-Coverage, whichever is applicable;

c)   SEC-approved Articles of Incorporation (for corporation) or valid Certificate of Business Registration from the Department of Trade and Industry (for single proprietorship)

d)   Environmental Impact Assessment, Initial Environmental Examination, or Project Description/Engineer’s Report, whichever is applicable;

e)   Plans (site development plan, vicinity plan, and drainage/sewer plan); and

f)   Shoreland Certification from the Special Concerns Division-LLDA if the site or project area is within shoreland barangays of Laguna de Bay.

The original copy of SEC-approved Articles of Incorporation or Certificate of Business Registration must be presented for authentication purposes. However, if the original copy of the documents is not available, a certified true copy thereof from SEC or DTI should be presented. 

Application form and its supporting documents shall be filed in two (2) copies. The third copy will be retained by the proponent as a received copy.  

LLDA shall accept only complete applications.

 

III.    Approval and Issuance of LLDA Clearance  

The LLDA Clearance shall be issued subject to such conditions as the Authority may impose including, but not limited to: 

a)   Submission of Locational Clearance or certification from the administrator of industrial park/estate or the Philippine Economic Zone Authority in the case of PEZA-administered industrial parks/zones;

b)   Submission of copy of water bills for the last three (3) months, water permit or water permit application from the National Water Resources Board (NWRB) or surface water permit from the LLDA;

c)   For subdivision or housing projects, submission of Engineering-Structural Geological Assessments.  

Failure to comply with any of the conditions of the approved/issued LLDA Clearance shall be subject to administrative fine under Board Resolution No. 42, Series of 1997.

 

IV.    Repealing Clause 

All circulars, orders, rules and regulations, memoranda and other issuances inconsistent with or contrary to the provisions of this circular are hereby repealed/amended or modified accordingly.   

 

V.    Effectivity 

This Memorandum Circular shall take effect immediately.
